These Terms apply to all visitors, users, and others who access the Site, including but not limited to individuals browsing inventory, submitting lead forms, using calculators or tools, scheduling service appointments, or accessing the administrative panel.

3. Inventory & Pricing Disclaimers

Jensen Ford makes every effort to present accurate and current vehicle information on the Site. However, all vehicle listings, prices, specifications, and availability are subject to change without notice.

Pre-owned vehicle pricing reflects the listed internet price at the time of publication. Pre-owned vehicles may have had prior damage, mechanical issues, or other conditions not immediately apparent in online listings. Jensen Ford recommends inspecting any pre-owned vehicle in person and reviewing the vehicle history report before purchase.

Jensen Ford is not responsible for errors in pricing or vehicle information caused by data feed delays, software errors, or third-party data provider inaccuracies. In the event of a pricing error, Jensen Ford reserves the right to correct the error and is not obligated to honor an incorrect price.

4. Incentives & Rebates

Manufacturer incentives, rebates, and special offers displayed on the Site are provided by Ford Motor Company and are subject to change at any time without notice. These offers may have specific eligibility requirements including but not limited to residency, military status, first responder status, vehicle ownership history, or financing through Ford Credit.

Incentive amounts shown on the Site represent the maximum available discount and may not apply to all customers. Not all buyers will qualify for every incentive displayed. Final incentive eligibility is determined at the time of purchase based on the customer's individual qualifications and the current manufacturer program rules.

Jensen Ford does not guarantee the availability or amount of any manufacturer incentive. Offers may expire, be modified, or be withdrawn by the manufacturer at any time. Jensen Ford is not responsible for changes to manufacturer programs that occur between the time information is published on the Site and the time of purchase.

5. User Submissions & Lead Forms

The Site provides various forms through which you may submit personal information, including but not limited to: sales inquiries, service appointment requests, finance and credit applications, trade-in valuations, parts requests, collision repair inquiries, rental inquiries, price alert sign-ups, and general contact messages.

By submitting information through any form on the Site, you represent that the information provided is accurate and truthful. You consent to being contacted by Jensen Ford or its authorized representatives regarding your inquiry via the contact methods you provide, including phone, email, and text message.

Lead form submissions are routed to the appropriate Jensen Ford department via email. Sales inquiries are transmitted to Jensen Ford's customer relationship management system in ADF/XML format. Jensen Ford takes reasonable measures to protect submitted information, but no internet transmission is completely secure. You submit information at your own risk.

Credit applications submitted through the Site are preliminary and do not constitute a formal credit agreement. Any financing terms are subject to lender approval and may differ from estimates provided on the Site.

6. Accounts & Authorized Access

Certain areas of the Site, including the administrative panel, are restricted to authorized Jensen Ford personnel. Unauthorized access or attempted access to restricted areas is prohibited and may result in legal action.

If you are provided credentials to access any restricted area of the Site, you are responsible for maintaining the confidentiality of those credentials. You agree to notify Jensen Ford immediately of any unauthorized use of your credentials or any other breach of security.

7. Calculators & Estimation Tools

The Site provides payment calculators, trade-in estimators, out-the-door pricing tools, and other interactive features for informational purposes only. These tools produce estimates based on the inputs you provide and general assumptions. They do not constitute an offer of financing, a guaranteed trade-in value, or a binding price quote.

Payment estimates are based on assumed interest rates, loan terms, and down payments that may not reflect your actual financing terms. Actual monthly payments, interest rates, and loan terms are determined by the lender and are subject to credit approval. Trade-in values are estimates only; actual trade-in value is determined upon in-person vehicle inspection.

Tax, title, license, and registration fee estimates are based on general Iowa rate calculations and may not reflect your exact situation. Registration fees in Iowa are prorated to the owner's birth month. Actual fees are determined by the county treasurer at the time of registration.

The Ford name, Ford logo, and all Ford vehicle names and trademarks are the property of Ford Motor Company and are used by Jensen Ford under authorized dealership agreement. CARFAX and CARFAX logos are registered trademarks of CARFAX, Inc.

You may not reproduce, distribute, modify, display, perform, or otherwise use any content from the Site without the prior written consent of Jensen Ford, except for personal, non-commercial use such as printing a vehicle listing for your own reference.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JENSEN FORD, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL JENSEN FORD'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE EXCEED THE AMOUNT YOU HAVE PAID TO JENSEN FORD, IF ANY, FOR ACCESSING THE SITE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF JENSEN FORD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

You agree to defend, indemnify, and hold harmless Jensen Ford, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Site; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that information you submitted through the Site caused damage to a third party.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Marshall County, Iowa, or the United States District Court for the Southern District of Iowa. You consent to the personal jurisdiction of such courts and waive any objections to venue.

14. Modifications to These Terms

Jensen Ford reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on the Site. The "Last Updated" date at the top of this page reflects the date of the most recent revision.

Your continued use of the Site after any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
